1. Eligibility & 21+ Venue
Parq Nightclub is a 21-and-over venue. By entering the venue or purchasing tickets or bottle service, you represent that you are at least 21 years of age and that you will present valid government-issued photo identification upon request. California law prohibits us from serving alcohol to anyone under 21, and we strictly enforce this requirement.
To use the interactive features of the website (forms, mailing list sign-up, VIP requests), you must be at least 18 years old.
2. Use of the Website
You may use parqsd.com for personal, non-commercial purposes only. You agree not to:
- Use the site to violate any law or to infringe the rights of others.
- Introduce viruses, malware, or other harmful code.
- Attempt to access any part of the site that is not intended to be publicly accessible.
- Scrape, copy, or republish substantial portions of the site without our written permission.
- Use the site to send spam, phishing, or unsolicited communications.
- Interfere with or disrupt the operation of the site or its underlying infrastructure.
3. Accounts, Forms & Communications
When you submit a form on the website (contact, VIP inquiry, private event inquiry, or mailing list sign-up), you agree to provide accurate and current information.
By submitting your phone number or email address in a form, you agree that Parq may contact you about your specific request. If you opt into the mailing list, we will also send you event announcements and promotional messages. You may unsubscribe at any time by clicking the unsubscribe link in any email or by emailing info@parqsd.com.
4. Tickets & Reservations
Tickets for Parq events are sold through third-party ticketing partners, including See Tickets, Eventim, and Eventbrite. VIP and bottle service reservations are managed through SevenRooms. Your purchase of a ticket or reservation is governed by the terms and conditions of the applicable third-party platform in addition to these Terms.
All ticket and reservation sales are subject to availability. Parq reserves the right to reschedule, substitute, or cancel events. In the event of cancellation, refunds will be handled by the ticketing platform on which the purchase was made, subject to that platform's refund policy.
5. On-Site Payments & Refunds
On-site payments for admission, bottle service, food, and beverages are processed through our point-of-sale provider, Toast, Inc. Gratuity, service charges, and applicable California sales tax may be added to your check. Prices, menu items, and bottle selections are subject to change without notice.
Sales of alcoholic beverages, food, and bottle service packages are generally final. If you believe you have been charged in error, please speak with a manager during your visit or contact us within 14 days of your visit at contact@parqsd.com so we can investigate.
6. Venue Rules & Right of Refusal
For the safety and enjoyment of all guests, Parq requires:
- Valid, government-issued photo ID showing you are 21 or older.
- Compliance with our posted dress code, which may be updated for specific events.
- Respectful conduct toward other guests, performers, and staff.
- Cooperation with security regarding bag checks, capacity, and safety requests.
Parq reserves the right, in its sole discretion, to refuse entry to or remove from the premises any person who is visibly intoxicated, whose conduct is disruptive, unsafe, or unlawful, who fails to comply with venue rules, or who otherwise poses a risk to the experience or safety of other guests or staff. No refunds will be issued to persons removed for violation of venue rules.
California and San Diego law require that alcohol not be served to visibly intoxicated persons. Our staff will decline service in those cases.
7. Private Events
Private event bookings at Parq Event Center are governed by a separate written agreement between the client and WSA Entertainment LLC. Inquiries submitted through the website are not binding until a signed agreement and any required deposit are received.
8. Intellectual Property
All content on the website — including the Parq name and logo, photography, video, graphics, design, and text — is owned by WSA Entertainment LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the site without our prior written permission.
Event artwork, performer names, and third-party trademarks appearing on the site are the property of their respective owners and are used with permission or under fair use.
9. User Content & Photography
If you submit content to us — through a form, an email, a social media tag, or otherwise — you grant Parq a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content in connection with our business, including on our website and social media channels. You represent that you have the right to grant this license and that your content does not infringe the rights of any third party.
Photography and video in the venue: Parq, its partners, and its guests may capture photographs and video recordings in the venue. By entering the venue, you consent to being photographed or recorded and to the use of such images by Parq for promotional and marketing purposes. If you do not want your image used, please notify a staff member before entering.
10. Third-Party Services & Links
Our website links to and integrates with services operated by third parties, including See Tickets, Eventim, Eventbrite, SevenRooms, Toast, Paylocity, Google, and Meta. We are not responsible for the content, policies, or practices of those third parties. Your use of those services is governed by their own terms and privacy policies.
11. Disclaimers & Limitation of Liability
The website and all services, content, and information are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Parq does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by California law, Parq, its parent, affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the website, your purchase of tickets or bottle service, or your visit to the venue, even if Parq has been advised of the possibility of such damages.
Parq's total aggregate liability to you for any claim arising out of or related to these Terms or the website will not exceed the greater of one hundred dollars ($100) or the amount you paid to Parq in the twelve (12) months preceding the claim. Some jurisdictions do not allow certain limitations, so portions of this Section may not apply to you.
Nothing in these Terms limits any right you have under California law that cannot be waived by agreement, including rights related to intentional wrongful acts, gross negligence, or violations of the California Song-Beverly Consumer Warranty Act or similar consumer protection statutes.
12. Dispute Resolution & Arbitration
12.1 Informal Resolution
Before filing any claim, you agree to contact us in writing at info@parqsd.com and give us sixty (60) days to resolve the dispute informally.
12.2 Binding Arbitration
If we cannot resolve the dispute informally, you and Parq agree that any dispute, claim, or controversy arising out of or related to these Terms, the website, or your visit to the venue will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, in San Diego, California. The arbitrator's decision will be final and binding.
12.3 Class Action Waiver
You and Parq agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
12.4 Exceptions
Either party may bring an individual claim in small claims court if it qualifies. Either party may also seek injunctive relief in court to protect intellectual property rights. These Terms do not prevent you from filing a complaint with a government agency.
12.5 Opt-Out
You may opt out of the arbitration agreement and class action waiver within thirty (30) days of first agreeing to these Terms by sending a written opt-out notice to info@parqsd.com with your name, address, and a clear statement that you are opting out. Opting out will not affect any other part of these Terms.
13. Governing Law & Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. For any dispute not subject to arbitration, you and Parq agree to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.
14. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last Updated" date. Material changes will be announced by a notice on the website or by email to mailing list subscribers. Your continued use of the website or the venue after the effective date of the revised Terms constitutes your acceptance of them.
